Minutes of Dialogue between the MC and Residents

The Dialogue with the Management Council (MC) started at 4.00pm sharp with Ms Sathyia taking the floor, joined later by Puan Sharifah and Mr Alex.

We were informed that the Chairman, Mr Pang as at 11th March 2009; having received the payment from the sale of his unit at Casaria, is no longer eligible to hold the post. We were further informed that there are currently only three (3) council members with an addition (reserved) member but two of them are not present.

The residents were informed that the council committee was formed in March 2008 when only a handful out of the 120 registered owners attended the AGM, with the formal hand over by Syarikat Maluri (SM) in October. The MC was given RM10,000.00 by SM to open a bank account; this amount was separated into 50/50 for maintenance fees and sinking fund. After 90 days (3 months) a further sum of RM270,000.00 was handed over to the said MC by SM, this has since kept in a fixed deposit account. The MC has since been running on monthly collections of the maintenance fee and sinking funds. To date there is an outstanding debt of RM1 million in unpaid maintenance fees and sinking fund from the hand of SM.

Ms Sandra R of unit no: 255-xx-xx has expressed to the two council members present, namely Pn Sharifahh and Mdm Sathyia at the dialogue in the presence of Mr Alex of the maintenance company that majority of the residents wish to re appoint Syarikat Maluri to run the maintenance and upkeep of the Casa Ria Apartment complex; and Syarikat Maluri has expressed their willingness to this effect.

In light of the time frame required and due to the beginning of 'Ching Bing' which might result in the unavailability of enough participants, the EOGM as requested by Sandra was deemed unsuitable, we then agreed to a AGM to be held on Sunday, 26 April 2009, at 3.00pm at the Multi-Purpose located on the ground floor of the tower block. This AGM will be to elect a new Council Committee to run the management company (PPCR).

Procedure will be: if there are not enough forums at 3.00pm sharp, there will be a half hour wait after which, if the situation persists; the AGM will be postponed to be held a week later on Sunday, 3 May 2009, at 3.00pm at the same venue.

Requirement to qualify to be elected Council Members:
Must be registered owners on the strata titles with fully paid up maintenance fees.

Availability to Vote:
Proprietors and 1st chargee (bank) according to the Malaysian Statute with paid up of maintenance fees and sinking funds to 28th February 2009.

With the business of the Dialogue in regards to the matters of AGM having been dealt with; the dialogue was opened to the floor to hear the residents’ complaints and the response from the maintenance company.

We were updated that the repairs for the auto-gate sensors will commence this week after the insurance company had given them the go-ahead. Likewise for the repair works for the numerous potholes in the roads within the apartment complex which conditions further deteriorated with the closure of gates 1 and 2 and the rainy spell we are currently experiencing.

The residents also complained about the garbage disposal and the maintenance people on the ground. We were informed that the garbage trucks will be making their rounds to collect garbage three times a week at a charge of RM450.00 per month.

Discussion was also made on the idea of creating an auto-gate for Gate 3 with card sensers.

We were also updated that the defaulters of the maintenance and sinking fund fees will still be held responsible for paying up their debts in event they wished to sell their units. The relevant lawyers for the purchasing parties will be informed of any outstanding monies owed to PPCR/us.
But we are most concerned on how to ensure that current and future payments of maintenance and sinking fund fees are paid by those who are overdue currently for many months.

Update on 8th March 2009 Meetup

We thank you for the tremendous turnout at the last meeting held on Sunday, 8th March 2009. You must agree that this turnout is only possible if notice is properly issued and not that we, the residents at Casa Ria Apartment are not interested to attend; as evidenced by the poor turnout in March last year (due to the fact that only a small selected group of owners were notified).

We even had the pleasure of the attendance of an elected Council Member, Puan Shariffah Azlina Syed Hussain, who by being present and making her available to us the residents; helped clear the air of animosity between the council members, the chairman and the residents. This meeting has also brought about an invitation to:

Puan Shariffah had updated us that of the initial six (6) Council Members elected last March, three (3) had since resigned, leaving three council members who by virtue of their numbers and inexperience, unable to cope and affectively manage the complex. Furthermore, (#1) we learnt that the Chairman, Mr Pang had since sold his apartment unit and is no longer residing at Casa Ria even.

Even more disturbing news is that (#2) PPCR had inherited a highly unsatisfactory state of accounts from the developer, Syarikat Maluri Sdn. Bhd. The developer had failed to collect an amount of maintenance and sinking fund fees amounting to RM1million over the years from the long line of unit owners. (#3) How they had allowed this accumulation without taking the necessary steps to curtail this, is mind bloggling! Is there foul play at hand?

(#4) This issue needs to be addressed to by the residents for past non-payments, current and future payments of the said maintenance and sinking fund fees. Payment of the said maintenance and sinking fund fees is MANDATORY once you put your signature to the S&P agreement.

(#5) And having collected the monthly maintenance and sinking fund fees, how to ensure that the monies are spent to ensure that the various services required at the apartment complex meets satisfactory levels in relation to monies collected.

(#6) In order to ensure that matters arising and pertaining to the maintenance of the apartment complex, a strong and pro-active team of committee members (council members) headed by a responsible, dedicated and accessible chair person is ARDENTLY SOUGHT for.

Therefore, fellow residents, your continued support and attendance at the various meetings are crucial and absolutely required to achieve our aim ~ towards a pro-active and effective council committee!

HELLO FELLOW NEIGHBORS,

Hello fellow neighbors,

I have been living here in Casa Ria for more than 13 years but I have to say that I don't know not many neighbors. It is really a shame! Now the change of the management company has somehow wakened up us people out of our slumber. Hurray, that is something good in a sense.

The gatherings of the residents, who are concerned about the bad maintenance, bad security and bad roads, have created a beginning, hopefully a good beginning for us to develop a kind of community spirit. We should do that, because we live all together in the same condominium/apartment complex sharing common things like the clubhouse, the swimming pool, the tennis court and others.

It all belongs to all the residents and as these things have to be taken care off, the maintenance company with the cleaners, the technicians and the like come in. We as residents have the duty to us all to chip in to pay for these services no matter if we go using the swimming pool or the tennis court or hang-out at the clubhouse, because our property is designed in such a way that we have to pay the service fees as well as we have to pay TNB for the electricity, Gas Malaysia for the gas, the grocer for the groceries that we buy.

Here we buy the service at the very moment when we sign the purchase agreement. So I hope all the residents who are enjoying the services will also contribute, because without the money we will not be able to pay for the services!

So before we go after the present management committee of Casa Ria, we should give them a chance to rectify their mistake by not organizing a meet the residents earlier. We are all human and humans make mistake. Talk and communicate, that is the key to kill off rumors and gossip.

We are organizing a meeting to inform our fellow residents (owners & tenants) of our rights in light of the unsatisfactory maintenance of the apartment complex in addition to various management concerns pertaining to AND arising from the unhelpful management committee team (PPCR) currently in place and its maintenance company. Our aim is to get written support by way of 150 signatures to demand the audience of the chairman of PPCR to meet us with regards to (1) provide us with proper accounting documents for the monies collected i.e. our monthly maintenance/service fees and (2) monies collected from paid fines on clamping of vehicles.

We advise all attendees to read their S&P documents (a) page 14, Clause 8.2(c) for our rights to see the accounts and (b) page 9, Clause 17 on (Fire & Property) Insurance ~ where we seriously need to look into adding ‘break-in/burglary’ in light of numerous break-ins lately.

Kindly take note that this is NOT A RESIDENTS COMMITTEE MEETING but a gathering of concerned residents; therefore please do not bombard the speaker with all your complaints. Also rise your hand (and wait your turn) for motion to speak; and the speaker will certainly listen and he expects the same courtesy from the floor.
